Regulation & compliance

Trust is our first deliverable.

Media, advertising and virtual assets each carry their own rules. Here is how MER meets them. This summary is for information only and does not constitute legal advice.

01

Licensing & regulatory status

MER General Trading FZ is a free-zone entity in the United Arab Emirates. Media and advertising activities are carried out in line with the licence activities granted by its free-zone authority and with UAE federal media law.

Virtual-asset activities, including NFT brokerage, are regulated in Dubai by the Virtual Assets Regulatory Authority (VARA) and at federal level by the Securities and Commodities Authority (SCA), with other regimes applying in ADGM and DIFC. MER provides NFT brokerage only to the extent permitted under its licences and any required approvals; where an activity requires a licence MER does not hold, the service is not offered or is conducted via an appropriately licensed partner.

02

Anti-Money Laundering & Counter-Terrorist Financing

We follow Federal Decree-Law No. 20 of 2018 on AML/CFT (as amended) and its implementing Cabinet Resolution, applying a risk-based approach.

Measures include: customer due diligence and enhanced due diligence for higher-risk clients, beneficial-ownership identification, source-of-funds and source-of-wealth checks, ongoing transaction monitoring, on-chain wallet analytics, and Suspicious Transaction Reports to the UAE Financial Intelligence Unit via goAML.

A designated Compliance / MLRO function oversees the programme, staff receive regular training, and records are retained for at least five years.

03

Know Your Customer (KYC / KYB)

Individuals: valid passport or Emirates ID, proof of address, and a liveness check. Corporates: trade licence, constitutional documents, register of shareholders and UBOs, and authorised-signatory identification.

We do not onboard anonymous clients, shell companies without verifiable ownership, or persons under 21 years of age.

04

Sanctions & PEP screening

All clients, counterparties and wallet addresses are screened against the UAE Local Terrorist List, UN Security Council consolidated list, and other relevant lists including OFAC, EU and UK, together with politically-exposed-person and adverse-media databases — at onboarding and on an ongoing basis.

We apply the FATF Travel Rule to qualifying virtual-asset transfers.

05

Risk disclosure

NFTs and other virtual assets are high-risk. Prices can be extremely volatile and markets may be illiquid. You may lose the entire amount you spend. Smart contracts can contain bugs; platforms and marketplaces can fail; regulations can change.

Owning an NFT does not necessarily grant copyright or commercial rights in the underlying artwork unless expressly licensed. MER does not provide investment, legal or tax advice — please seek independent advice before transacting.

06

Advertising & media standards

Our campaigns comply with UAE media content standards, the UAE Media Council rules (including advertiser and influencer permits where required), consumer-protection law, and platform policies.

We do not produce advertising that is misleading, uses unverifiable claims, or promotes virtual assets in breach of VARA's marketing regulations — including the requirement for clear risk warnings in any virtual-asset promotion.

07

Data protection & privacy

Personal data is processed in accordance with Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL) and applicable free-zone data rules. We collect only what we need, store it securely, restrict access, and retain it only as long as legally required.

You may request access, correction or deletion of your data, subject to our legal record-keeping obligations under AML law.

08

Terms, conflicts & complaints

All engagements are governed by written terms setting out scope, fees, commissions and responsibilities. Conflicts of interest are identified, disclosed and managed; we do not trade against clients.

Complaints can be submitted through our contact page and are acknowledged within a defined timeframe and escalated to the Compliance function.
